Should tipping at restaurants be banned?

Leaving a generous tip is a nice way for customers to show their appreciation for the service provided to them. To discourage tipping may cause confusion for guests and it removes the emotional connection that servers and diners have become accustomed to as part of the restaurant-going experience.

Why tipping should not be banned?

It creates an incentive to be entrepreneurial. Tip-starved waiters, for instance, might rush customers and degrade their dining experience (which, incidentally, would degrade their tips, too). And on busy days some waiters could take more tables than they’re able to handle, impacting service for everybody.

Studies have shown that tipping is not an effective incentive for performance in servers. It also creates an environment in which people of color, young people, old people, women, and foreigners tend to get worse service than white males.

Under California law, employees have the right to keep any tips that they earn. Employers may not withhold or take a portion of tips, offset tips against regular wages, or force workers to share tips with owners, managers or supervisors. Tips are also separate from wages.

The customary amount of a tip can be a specific range or a certain percentage of the bill based on the perceived quality of the service given. It is illegal to offer tips to some groups of workers, such as U.S. government workers and more widely police officers; the tips may be regarded as bribery.

The most important aspect of tipping, is that servers support the tipping system. Tipping provides an incentive for exceptional customer service that creates unlimited earning potential for servers. Typically servers earn between $19-25 per hour but many earn significantly more.

Why are tips mandatory?

Because they want to help the server, because they want to show off, because they think the server did a spectacular job and deserves something extra. But once those people start tipping, that’s going to put social pressure on everyone else to tip, too. And some people will succumb to that pressure, others won’t.

Can restaurant keep tips?

In most other states, employers may pay employees less than the minimum wage, as long as the employees earn enough in tips to make up the difference (called a “tip credit”). However, California does not allow employers to take tip credits.

Is it rude to not tip?

In the US, yes it is extremely rude not to tip, barring extreme rudeness from the service. You don’t have to say “please” or “thank you,” or to desist from calling receptionists obscene names, either.

Is tipping illegal anywhere?

Not all states have tip credits. California, Montana, Nevada, Minnesota, Oregon, Alaska, and Washington have outlawed tip credits. This means that servers are paid the state minimum wage in addition to their tips. Some restaurants, especially in these states, have adopted a “no tip” policy altogether.

Is it legal to ask for tips?

Tip Basics Under California law, an employer cannot take any part of a tip that’s left for an employee. This means that you can’t be forced to share your tips with the owners, managers, or supervisors of the business (who are all considered to be the agents of the employer).
