Can you have a civilian job while in the reserves?

This includes your initial employment; an employer can’t refuse to hire you because you’re in the reserves, and he can’t fire you if you join the reserves after you’re hired. Employers also can’t deny you a promotion or any employment benefit because of your service.

Can I work my civilian job while on military orders?

In general it is safest to keep your civilian job completely separate from your military service. Some troops serve on active duty in the National Guard but are stationed close enough to their home address that they can effectively work their civilian job at the same time.

How long must an employer hold a job for someone in the military?

USERRA establishes the cumulative length of time that an individual may be absent from work for military duty and retain reemployment rights to five years (the previous law provided four years of active duty, plus an additional year if it was for the convenience of the Government).

Can you join the reserves if you have a full time job?

Yes you can work a full time job and should have full time employment as the Guard provides little compensation. Most training is on weekends and longer drills are 2 weeks. Its military service, the company has to let you go and participate in it, especially if you are called for deployment (which is federal).

Can I be fired while on military orders?

Employers cannot fire an employee because of military leave. Because of the nature of active military duties, advance notice is not required, unlike civilian leave laws like FMLA or CFRA; however, the DoD highly recommends an advance notice of 30 days when it’s possible.

Prevent firing without cause – In addition to being protected from discrimination, employees who take military leave of absence are also protected from retaliation. Employers cannot fire an employee because of military leave.

Can my employer deny my military leave?

No. As stated previously, an employer may not require documentation for notification prior to military duty. Further, an employer does not have a”right of refusal” for military leave of absence, so long as the employee has not exceeded the 5 years of cumulative service provided under USERRA.

Can you fire a reservist?

PROTECTED STATUS Reservists previously employed for more than 30 days can’t be fired without cause during their first six months back on the job. Those returning after more than 180 days of service can’t be fired without cause within one year.

The Uniformed Services Employment and Reemployment Rights Act (USERRA) is a federal law that gives members and former members of the U.S. armed forces (Active and Reserve) the right to go back to a civilian job held before being called up for Active duty.
