Can a pregnant woman be divorced in Islam?

A woman can only be divorced in Islam while she is in a state of purity and her husband has not approached her for (sexual relations) or while she is pregnant and her pregnancy is very obvious. As for the divorced woman, if she is pregnant, she is entitled to alimony until her waiting period end.

Is divorce valid in pregnancy?

If in the event the wife is pregnant then the waiting period is till delivery of her child plus iddat period. Hence divorce is pronounced by the husband but the same will not become effective during pregnancy.

Is it permissible to divorce a pregnant woman in Islam?

The words “then divorce her when she is pure (i.e., not menstruating) or is pregnant” indicate that divorcing a pregnant woman is in accordance with the Sunnah. We have quoted in the answer to question no. 12287 the fatwa of Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him) on the ruling on divorcing a pregnant woman.

What is the second case of divorce in Islam?

The second case is if the divorce is written; if he intended it as such then his wife is divorced. This is the view of al-Sha’bi, al-Nakha’i, al-Zuhri, al-Hakam, Abu Haneefah and Malik, and it is the view that is narrated from al-Shafi’i.

Can a pregnant woman be divorced by Talaaq when she is pregnant?

Praise be to Allah. Shaykh Ibn Baaz (may Allaah have mercy on him) was asked whether a woman may be divorced by talaaq when she is pregnant. He said: This is an idea which is common among some people. Some of the people think that a pregnant woman cannot be divorced by talaaq.

Is divorce during menstruation a valid talaq in Islam?

Most jurist, however, consider it to be a valid talaq. ( Imam Abu Hanifah, Imam Malik, Imam Shafi and many others) Talaq according to sunnah is given during the period between the menses when the husband did not have sexual relations with his wife. Hazrat Abdullah Ibn Umar divorced his wife while she was menstruating.
